Buyer Policy
This Buyer Policy outlines the responsibilities, expectations, and protections that apply when you purchase or rent products through Flexigoods under a Rent-Fix Contract.
By placing an order or entering into a Rent-Fix Contract with Flexigoods, you agree to comply with this Buyer Policy together with our Terms & Conditions and Disclosure Statement.
1. Eligibility to Purchase or Rent
To enter into a Rent-Fix Contract with Flexigoods, you must:
- be at least 18 years old;
- provide accurate and complete personal information;
- provide valid identification when requested;
- have a valid New Zealand address; and
- meet Flexigoods approval requirements.
Flexigoods reserves the right to decline any application or order at its discretion.
2. Accurate Information
You agree that all information provided to Flexigoods is true, correct, and current.
Providing false, misleading, or incomplete information may result in:
- cancellation of your application;
- cancellation of your Rent-Fix Contract;
- repossession of Goods; or
- further recovery action where applicable.
3. Product Availability
All products are subject to availability.
If the exact product ordered is unavailable, Flexigoods may offer:
- a similar model; or
- an upgraded replacement with equal or better features at no additional cost.
If you do not wish to accept the replacement product, Flexigoods may cancel the order and refund eligible payments made before delivery.
4. Delivery Requirements
Before delivery can occur, you must:
- complete all required documentation;
- pay any required upfront or minimum weekly payments;
- arrange approved insurance or purchase the Liability Waiver; and
- provide accurate delivery details.
Delivery dates are estimates and may change due to circumstances outside Flexigoods’ control.
5. Buyer Responsibilities
During the Rent-Fix Term, you agree to:
- keep the Goods safe and in good condition;
- use the Goods only for normal household or personal purposes;
- keep the Goods at the approved address;
- not sell, sublease, lend, or dispose of the Goods;
- immediately report damage, theft, faults, or loss;
- keep payments up to date; and
- allow Flexigoods reasonable access to inspect or recover Goods where permitted by law.
6. Payments
You agree to make all scheduled payments on time in accordance with your Disclosure Statement and Rent-Fix Contract.
Payments may include:
- weekly instalments;
- delivery fees;
- liability waiver fees;
- late payment fees;
- cleaning fees;
- repossession fees; and
- other reasonable charges permitted under the agreement.
Missed or dishonoured payments may result in:
- penalty interest;
- default fees;
- cancellation of the contract; or
- repossession of Goods.
7. Ownership of Goods
All Goods remain the property of Flexigoods during the Rent-Fix Term unless ownership is separately transferred in writing.
Completion of all scheduled payments does not automatically transfer ownership unless specifically agreed by Flexigoods.
At the end of the agreement, you may have the option to purchase the Goods at an agreed market value price.
8. Repairs and Maintenance
Flexigoods is responsible for general servicing and maintenance unless damage is caused by:
- misuse;
- negligence;
- intentional damage;
- unauthorised repairs; or
- failure to follow manufacturer instructions.
Only Flexigoods or approved technicians may repair the Goods.
9. Returns and Early Cancellation
If you wish to end your Rent-Fix Contract early:
- you must contact Flexigoods directly;
- return approval is subject to contract terms;
- early termination fees may apply; and
- outstanding balances and charges must still be paid.
Goods returned must be clean, hygienic, and in acceptable condition.
10. Liability Waiver and Insurance
Buyers must either:
- maintain approved insurance for the Goods; or
- purchase the Flexigoods Liability Waiver.
The Liability Waiver may provide limited protection for qualifying theft or accidental damage events, subject to the Terms & Conditions.
11. Default and Repossession
You may be considered in default if you:
- miss payments;
- provide false information;
- damage or hide the Goods;
- move the Goods without approval; or
- breach the Rent-Fix Contract.
If default occurs, Flexigoods may:
- cancel the contract;
- recover the Goods;
- charge additional fees; and
- pursue outstanding balances permitted under New Zealand law.
12. Consumer Rights
Nothing in this Buyer Policy limits your rights under the Consumer Guarantees Act 1993, the Fair Trading Act 1986, or other applicable New Zealand consumer protection laws.
13. Privacy
Flexigoods collects and stores personal information in accordance with New Zealand privacy laws.
Your information may be used for:
- credit assessment;
- account management;
- customer support;
- debt recovery;
- fraud prevention; and
- marketing communications where permitted.
